We are experienced IT professionals who not only know how to design software; we are also experienced in software litigation.
We have, unfortunately, seen too many examples of deception and totally inappropriate business practices. We have been fixing problems caused by the obvious incompetence of some software developers. Often the programmers did such a poor job, that if was easier to redo everything from scratch than to complete the unfinished product. There are many great, competent and hard-working computer programmers. However, there are too many programmers who do not have professional-level skills and education. The programming product can be only as good as the programmers who design it.
Suppose you need to develop software for your business. So, you hired a software development company. You agreed on everything with your contractor. You spent a great deal of time writing requirements and making sure that there was no miscommunication. The contractor apparently understood what was to be done and when it had to be delivered. Also, the contractor assured you that only the best programmers would be assigned to the project. They would be loaded with the best tools and familiar with the newest technologies.
Of course, it wasn’t cheap. Each programmer costs $150 - $200 per hour. However, after they started, the milestones were not exactly met. Then they are asking for more time (and more money!). At the end you were left with unusable product.

Aren’t you entitled to get your money back? Naturally, the company you hired doesn’t want to refund the money. Litigation is your only option.

Some may think that there are programming experts who know everything. However, computer programming is a very large field; nobody knows all the technologies. If we are the right experts for the job, we will take the case. Otherwise, we may be able to refer you to someone else.
Note that some attorneys say that programming malpractice, or computer malpractice, or software development malpractice may not be a winning case. This is because some judges think that anything with words "software" or "programming" is not a profession. If your attorney agrees with this, you can sue for breach of contract or negligence. Your objective is to be compensated; the rest is technicalities.
This “opinion” stated by some judges — that computer programming is not a profession — sounds very unjust for us professionals. There are college degrees available in Computer Science, Computer Engineering, Information Systems. We have numerous certifications that exist in practically every technology. There are standards published.
